On January 26, 1921, appellant brought this suit against appellee Eastland, Wichita Falls & Gulf Railroad Company, in substance setting up that in April, 1920, it shipped -three steel tanks from Houston Heights, Tex., to Eastland, Tex., for which the initial carrier issued three bills of lading to the order of appellant notify Harrell Pipe Dine Company (hereinafter called pipe line company), which bills provided for the delivery of the tanks upon surrender of the bills properly -indorsed; that it drew three sight drafts aggregating $7,-500 upon the pipe line company, indorsed the bills to the…
