STOKES, Justice.

This is a suit for divorce and the adjustment of property rights instituted by the appellee, Sybil McGarraugh, against her husband, the appellant, Albert E. McGar-raugh, upon the alleged ground of cruel treatment. The appellant answered by the general issue and in a cross action set up grounds of cruelty which he alleged had been committed by the appellee and upon which he sought a decree of divorce. The case was submitted to the court without the intervention of a jury and resulted in an unusual decree, dissolving the bonds of matrimony between the parties without specifying…
