Tke predecessor of appellee, as treasurer of Jay county, filed in tlie circuit court bis petition under *458§8587 Burns 1901, which provides that it shall be the duty of every administrator having the property of any decedent in charge to pay the taxes due upon the property of such decedent, and ripon his failure to do so, when there is money enough on hand to pay the same, the county treasurer shall present to the circuit court, or other proper court of the county, a brief statement, in writing, “setting forth the fact and amount of such delinquency,” and the court shall at once issue an order,…
