FOSTER, Justice.
This is an action for an assault and battery alleged to have been committed by the agents of defendant on plaintiff.
Defendant filed a plea in abatement in substance that it is an Alabama corporation; that at the time the cause of action arose and at the time of the institution of the suit, and at all intervening times it was not doing business by agent in Jefferson County (where the suit was begun) ; that the matters complained of occurred in Etowah County, Alabama, where defendant is amenable to suit.
