Plaintiff in error, Arthur Hansen, was convicted by a jury of the burglary of a jewelry store in the city of Chicago and was sentenced to a term of three to seven years in the penitentiary. He has brought the case here by writ of error to review the sufficiency and competency of the evidence.

On the early morning of January 1, 1953, two men, named Hagl and Fairchild, were shot and killed by the police in the street near the jewelry store alleged to have been burglarized, and plaintiff in error was wounded by the police as he was driving his automobile a short distance from the store.
