Motion by the defendants, pursuant to CPLR 3211, for an order dismissing the complaint upon several grounds; viz., that the court does not have jurisdiction of the subject matter, that the complaint does not state a cause of action, and that the plaintiffs are not the real parties in interest. The issue of jurisdiction, however, is the focus of the controversy.
