Malcolm Davis and Monroe Seibel (the “Creditors”), prepetition judgment creditors of Mid Atlantic Fund, Inc. (“Mid Atlantic” or “Debtor”), filed a motion on November 20, 1984 seeking an order directing the Trustee in this Chapter 7 bankruptcy proceeding to account for and turn over all monies received pursuant to a certain note and mortgage (collectively the “Frede-baugh Mortgage”) and to deliver to the Creditors the original note and mortgage and assignment.
