ERROR TO THE CIRCUIT COURT OF THE UNITED STATES FOR THE NORTHERN DISTRICT OF ILLINOIS. The facts, which involve the jurisdiction of this court under § 5 of the Judiciary Act of 1891 and of the Circuit Court of actions on materialmen bonds, are stated in the opinion.

This was an action by the United States against the principal and sureties on a bond, given conformably to the act of August 13,1894, c. 280, 28 Stat. 278, as amended February 24, 1905, c. 778, 33 Stat. 811, for the.performance of &■ contract for the construction of a public building, and containing the required additional condition relating to the payment of claims for labor and materials.
