In this action the plaintiffs, consisting of three corporations bearing the family name “Paeelli,” and two brothers, Clarence and Guido Paeelli, have sued a third brother, Torino Paeelli, for damages resulting from fraudulent misrepresentations claimed to have been made when they purchased his interests in the corporations. The defendant, Torino Paeelli, has filed a counterclaim based upon the refusal of the plaintiffs to pay the balance due on a promissory note given to him at the time of the purchase and also his share as a beneficiary in a profit sharing plan of one of the corporations.…
