Appeal from a dismissal of the first cause of action in a nonjury trial, the second and third causes of action and the counterclaim having been settled by stipulation. That part of the complaint with which we are concerned alleged that in February, 1949, the parties agreed in a written contract that the plaintiff would be the exclusive distributor of defendant’s products in a definite territory and that plaintiff was entitled to commissions and other benefits from sales.
