Appeal from the District Court of Potter County. Tried below before Hon. J. BT. Browning.
1Opinion of the Court
W. H. Rogers recovered a judgment for three hundred dollars against each of the defendants, the Chicago, Rock Island Gulf Railway Company and the Chicago, Rock Island Pacific Railway Company, on his claim for damages for alleged negligence in the shipment of twenty-eight head of horses belonging to the plaintiff. The horses were shipped from Carlsbad, New Mexico, to Altus, Oklahoma. A portion of the route of shipment was over lines of other railway companies who were also made defendants in the suit, but judgment was rendered in favor of those companies.
