The Montgomery Improvement Association, Inc., an organization of low and moderate income black residents of the City of Montgomery and four individual low income black city residents brought this action for declaratory and injunctive relief against the Department of Housing and Urban Development (HUD) and the City of Montgomery.1 Plaintiffs allege that neither the City’s applications nor its implementations of its 1975, 1976, and 1977 plans of improvement are in compliance with the Housing and Community Development Act of 1974 (“Community Act”).2 Their complaint…
