The vital question in this case is whether the plaintiff, The Independent Torpedo- Company, is entitled to recover the $1,500 that it deposited with the agents of the defendants to apply on the purchase price of the property in contro-very. The contract provides for the deposit of $1,500 to apply on the purchase price; that the purchase price was to be $15,000, $11,000 to be paid on presentation of a war ranty deed, showing the property free and clear of all incumbrances except an existing mortgage of $2,500.
