*742Appeal from an order of the Supreme Court (Demarest, J.), entered September 23, 1999 in St. Lawrence County, which denied defendant’s motion for summary judgment, inter alia, dismissing the complaint.

Plaintiff is a public utility, regulated by the Public Service Commission (hereinafter PSC), which supplies natural gas to approximately 14,000 customers most of whom are residential users and small business owners classified as “firm” customers.
