Appeal from an order of the Supreme Court (Donohue, J.), entered May 6, 1998 in Albany County, which granted defendant’s motion for summary judgment dismissing the complaint.
In March 1992, plaintiff and defendant entered into a public works contract for asbestos abatement at Mohawk Valley Psychiatric Center in the City of Utica, Oneida County.
