A jury convicted Ruben Sasnett of DUI Manslaughter in violation of Section 316.-193, Florida Statutes, pursuant to the Assi-milative Crimes Act, 18 U.S.C. §§ 7, 13. Thereafter, in accordance with the Sentencing Guidelines, the district court imposed a sentence of 60 months imprisonment, to be followed by a term of supervised release of three years. Although the district court determined that Mr. Sasnett did not have the then present ability to pay a fine or restitution, and therefore did not order either, it held that the issue of restitution could be reopened at a later date.
