Appeal by the defendant, Max Miller, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 10th day of June, 1912, upon the decision of the court after a trial at the New York Special Term, and also, as stated in the notice of appeal, from the refusal of the court to make findings of fact and conclusions of law as proposed by the defendant.

Laughlin, J.:

This is an action for the dissolution of a copartnership alleged to have been formed between the parties on or about the 12th day of July, 1909, to conduct a general commercial printing business under the'name and style of Madison Square Press, and for an accounting and for the appointment of a receiver.

The plaintiff alleges that it was agreed that each of the parties should devote his entire time to the business and that the plaintiff should receive one-quarter and the defendant three-quarters of the profits, and that by an agreement subsequently made their proportionate…
