This is a writ of error to review a judgment rendered by the circuit court of the second circuit upon the ver*321diet of a jury awarding the plaintiff damages for the breach of the conditions of a bond given by the defendant Howell as principal and the United States Fidelity and Guaranty Company as surety for the faithful performance of his (Howell’s) duties as county engineer of the County of Maui.
