Appeal from a judgment of the County Court of Albany County (Clyne, J.), rendered February 24, 1984, upon a verdict convicting defendant of the crime of attempted rape in the first degree.

On the morning of June 9, 1983, defendant met Terri Gillis at a detoxification center in the City of Albany. Gillis spent *644the remainder of the day drinking wine in Washington Park.
