BARKSDALE, District Judge.

This case having been tried upon the facts by the court without a jury, the court doth hereby find the facts specially and state its conclusions of law thereon, and direct the entry of the appropriate judgment, as follows :

Findings of Fact.

On April 5, 1938, plaintiff’s decedent, Dewey O. Combs, a student at the Virginia Polytechnic Institute at Blacksburg, Virginia, signed a written application to defendant company for a $5,000 life insurance policy, and delivered it to defendant’s soliciting agent, G.
