OPINION

The defendant in error moves the court to dismiss the petition in error filed by plaintiff in error herein for the following reasons:(1) More than forty days have passed since the overruling of the motion for a new trial and the plaintiff has not filed in this court a proper bill of exceptions.(2) More than forty days have passed since the filing of the entry of judgment in the court below and the plaintiff in error has not filed in this court a proper bill of exceptions.(3) There were no exceptions noted at the trial and there is no bill or record of the evidence on file…
