Plaintiff-appellant Anthony Madera here appeals the district court’s grant of summary judgment for defendant-appellee Marsh U.S.A., Inc. (“Marsh”) and defendant-appellee J & H Marsh & McLennan Severance Pay Plan (“Plan”), a severance pay plan adopted and maintained by Marsh in accordance with the provisions of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001, et seq.
