MEMORANDUM OF DECISION AND ORDER

This matter is before the Court on a motion for partial summary judgment filed by the plaintiff David King on April 29, 1996. Also before the Court is a motion for summary judgment filed by defendant Damiron Corporation1 on April 30, 1996. Plaintiff *1089responded to defendant’s motion for summary judgment on May 24, 1996 to which defendant replied on June 3, 1996. For the following reasons, the motion for partial summary judgment filed by plaintiff will be denied while the motion for summary judgment filed by defendant will be granted.
