CADWALADER, District Judge.

Persons accused of crime, who have been committed to official custody, are, in ordinary cases, entitled to immediate judicial liberat^n upon bail. In ordinary cases, and also in other cases, accused prisoners have the less immediate right of speedy trial according to the due course of procedure; and, if their trial is arbitrarily delayed, become entitled to liberation, as justice may require, either •on bail or absolutely.
