The decedent, Charles Huey, had been employed in defendant’s foundry for almost 15 years when on July 22, 1958, he suffered a back injury which arose out of and in the course of his employment. Although he attempted to work a few times in early 1959, decedent never worked again, and he was paid the statutory 500 weeks of compensation at the rate in effect at the time of his injury.

On February 23, 1968, only a few days after the 500 week period had expired, decedent filed a petition alleging disablement from an occupational disease occurring July 5, 1967. The nature of the disease was…
