In this action of. unlawful detainer by Biekel against 'Sheppard for possession of a bouse and lot in the City of Huntington, the court instructed the jury to find for plaintiff, and defendant prosecutes this writ of error.

Defendant defended his possession by virtue of a contract of purchase with plaintiff, dated April 2, 1923. It appears that Biekel was manager in this State and eastern Kentucky for a life insurance company of New York, and for some time prior to the date of the agreement of sale and purchase of the house and lot involved, Sheppard had been in his employ…
