In this adversary proceeding, the plaintiff, CainRash Architectural Group, Inc. (“CainRash”), seeks to enforce its architectural lien against property of the estate and a determination that its lien is superi- or to the mortgage held by First Tennessee Bank National Association (“First Tennessee”). Presently before the court is First Tennessee’s motion to dismiss pursuant to Fed. R. Bankr.P. 7012(b). At issue is the construction of Tenn.
