The appeal in this case is from the judgment of the district court which approved and affirmed an order of the probate court appointing an administrator for the estate of Noel Erwin, deceased.

We are advised by counsel that on January 25, 1948, an automobile driven by Leon Richardson, seventeen years of age, and an *317automobile driven by Noel Erwin, nineteen years of age, collided on one of the county highways of Labette county, with the result that both of the young men were fatally injured.
