William Bischer, Sr., filed his bill to the October term, 1908, of the circuit court of Putnam county, praying for the setting aside of a deed made by him to William Bischer, Jr., on September 5, 1896, and for an accounting. It was alleged that a part of the land so conveyed had been owned in common by complainant and his wife, Matilda Bischer, who died' intestate July 4, 1896, and her heirs were made parties defendant to the bill.
