ALLEN, Circuit Judge.

This appeal arises out of a judgment for personal injuries in favor of appellee. Appellant asserts that the court erred in denying his motion for directed verdict.

Appellant resides in Muskegon, Michigan, and during November, 1933, was engaged as a sub-contractor in the construction of state roads Nos. 31 and SO in Indiana. He had headquarters in Indianapolis.
