On the trial below William Green was plaintiff, and appellant defendant. Here parties appellee are Green and Soles.

Prior to December 21, 1927, Soles was the owner of a lot in Jefferson County, and contracted with Green to build a house thereon at a price of $400. When the house was completed Soles went to the Avery Building Association to procure cash to pay cost of materials and supplies, and obtained $1,100, for which amount he executed his note and a mortgage to secure its payment.
