Defendant, Carl Janaway, was convicted in the district court of Sequoyah county of the crime of assault with intent to kill, and by the court sentenced to serve a term of ten years in the State Penitentiary, and has appealed.
On August 22, 1945, this defendant filed in this court a petition for habeas corpus, seeking his release from the State Penitentiary where he was confined by reason of the judgment and sentence of the district court of Sequoyah county.
