DUVAL, District Judge.
Before this Court is a Rule 12(b) Motion to Dismiss (Rec.Doc. No. 21) filed by defendant Reed Elsevier, Inc. After reviewing the pleadings, memoranda, and relevant law, and after hearing oral argument, the Court GRANTS the motion.
I. BACKGROUND
Plaintiffs Betty D. Russell and Yvonne Morse brought the instant suit against defendant Reed Elsevier Services, Inc. (“Reed Elsevier”) in July of 2003, claiming, inter alia, that defendant violated the Driver’s Privacy Protection Act (“DPPA” or the “Act”), 18 U.S.C. § 2721, et seq.
