This is an action to recover taxes paid under protest. The complaint alleges that the county commissioners of Treasure county levied a tax of 19 mills on each dollar of the taxable value of property in the county for the year 1937, and that the levy was excessive and illegal to the extent of three mills, amounting to $1,477.77, as against plaintiff’s property; one-half of this amount was paid under protest, for the recovery of which this action was brought.
