Before the Court is the defendant/debt- or’s motion to dismiss the above captioned adversary proceeding pursuant to Bankruptcy Rule 7012 and Federal Rule of Civil Procedure 12(b)(6) (“F.R.C.P.”) for failure to state a claim upon which relief may be granted.
