In 1922 defendant J. ’Q. Anderson borrowed $17,000 from. Mitchell Trust Company, which indebtedness was represented by seventeen promissory notes in the principal sum of $1,000 each, due in 1928, which notes were also' signed by Clara L. Anderson (wife of the borrower) and were secured by first mortgage on a number of pieces of real property. Prior to the due date thereof, and in June, 1927, these seventeen notes and the mortgage securing the same were soldi and assigned by Mitchell Trust Company to J. H. Wright, now deceased.
