-By indictment, appellant was charged in Count I with committing an abortion upon Peggy Lamm and in Count II with committing an abortion upon Julie Alazar. After the appellant had entered a plea of not guilty and waived a jury trial, the matter was submitted on the grand jury transcript. The court found the appellant guilty on Count I of the indictment and not guilty on Count II.
