In the underlying small claims action, Tommy Lindsey (“Mr. Lindsey”) and Denise Lindsey (“Mrs. Lindsey”) sued Hyannis Air Services, Inc., doing business as Cape Air (“Cape Air”), alleging that Cape Air was liable for jewelry stolen from Mr. Lindsey’s luggage when he traveled on a Cape Air flight. At a bench trial, Cape Air asserted that its contract of carriage (“Contract of Carriage”) precluded liability for the missing jewelry.
