Plaintiffs Nancy Kowalski-Schmidt, Joanne K. Curtis, and Peter J. Wirs (collectively “Plaintiffs”) filed a complaint (the “Gross Negligence Complaint”) against chapter 7 trustee Daniel E. Forsch (“Trustee”) alleging gross negligence by the trustee in administering the estate of Debtors Marjorie A. Giordano and Richard E. Hamm, Jr. (“Debtors”). Trustee filed a motion to dismiss the Gross Negligence Complaint (the “Dismissal Motion”) along with a request for sanctions (the “Sanctions Request”).
