Presently pending is the application of Estes & Hoyt, A.P.C. (“applicant”) for allowance of fees and reimbursement of costs. The applicant is counsel for general partner and unsecured creditor Gordon A. Jacobs (“Jacobs”). At issue is whether applicant is entitled to compensation for attorneys’ fees and costs pursuant to § 503(b)(3)(D) and (4) of the Bankruptcy Code.
