Appeal from tlie Circuit. Court of the United States for the District of Kentucky. This was a suit by Oliver Watson and Letitia Souther, as executrix of Henry Souther, deceased, against the Society of Shakers at Pleasant Hill, Ky., Kapoleon D. Brown, James W. Shelton, and Mary Jane Sutton, trustees of said society, to subject the property of the society to a charge for the payment of a note. The circuit court rendered a decree for the complainants. Defendants appeal.

The first question raised by the defendants is one of jurisdiction, if being contended that the citizenship of Letitia Souther is not sufficiently shown to be different from that of the defendants. In the ozlginal bill, Watson was described as a citizen of üew York, and Henry Souther as a citizen of Virginia. The hill styled “supplemental,” of Letitia Souther, does not show her citizenship. The amended bill describes her as being a nonresident of Kentucky, but does not allege her citizenship there. The defendants, therefore, insist that she, being, as they also…
