The plaintiff C. P. Brown brought this action to foreclose a mortgage for $5,000 given by AV. H. Sartor on May 1st, 1905, and recorded on May 2nd, 1905. There is no dispute as to the validity, priority and amount of the plaintiff’s mortgage, and in the consideration of the case that debt will be left out of view entirely; but other creditors of W. H. Sartor were made parties defendant and there are complex questions to be decided as to the rights of these creditors against each other in the distribution of the surplus proceeds of sale…
