PARKER, Circuit Judge.

This was an action at law, instituted by the trustee in bankruptcy of the Capital City Garage & Tire Company of Columbia, S. C., against the Firestone Tire & Rubber Company and its subsidiary company, the Oldfield Tire Company, hereinafter called defendants, to recover the possession of certain automobile tires and accessories or their value. The ease was referred to a referee in accordance with the practice prevailing in the state courts of South Carolina.
