The Department of Environmental Resources (DER) petitions for review of orders of the State Civil Service Commission (Commission) that sustained the appeals of Kenneth A. Bartal and six other DER employees in their challenges, based on claims of discrimination, to DER’s reclassifi cation of their positions downward. 1 Before June 29,1989, the employees were classified as Sanitary Engineer (SE) 5, Air Pollution Control Engineer (APCE) 5 or Sanitarian Program Manager (SPM).
