MEMORANDUM AND ORDER

MacLAUGHLIN, District Judge.

This action was instituted by Walter Witzel, a purchaser of London Commodity Options, to recover the sum of $19,300 which plaintiff alleges he lost as a result of fraudulent omissions and misrepresentation made in connection with solicitation efforts by defendant’s agents. The plaintiff also seeks to recover attorneys’ fees and costs should he prevail on certain state law claims.
