On the 24th of March, 1832, a treaty was made between the United States and the Creek tribe of Indians, east of the Mississippi river. Both parties claim the land iu controversy under the United States, in virtue of the treaty of Washington, made on the 24th March, 1832, between the United States and the chiefs of the Creek tribe of -Indians. The decision of the Supreme Court of Alabama was against .the tide set up by the plaintiff, the. case is therefore properly brought here under the 25th section of the Judiciary-act of 1789.
