Plaintiff is one of eleven locomotive engineers employed by the city of New York, department of sanitation, after competitive civil service examination. The employment is on a per diem basis, to be paid only for the days on which employed, at the rate of ten dollars and fifty cents per day. The duties of locomotive engineer consisted of operating the small locomotives which are used to pull one or more dump cars from the bulkhead of Rikers Island back to the dumps in the interior of the island.
