Appeal by the defendant, The City of New York, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 8th day of July, 1899, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 19th day of July, 1899, denying the defendant’s motion for a new trial made upon the minutes.

Rumsey, J.:
There is no dispute about the facts in this case. The plaintiff, who is a veteran of the war of the Rebellion, and was honorably discharged from the service, was appointed a cleaner in the department of public buildings, lighting and supplies, and subsequently detailed as watchman in the county court house in the city of New York, in the month of November, 1888, at the salary of fourteén dollars a ■ week.
