MEMORANDUM

BLAKE, District Judge.

This case involves a dispute between the plaintiff, Empire Fire and Marine Insurance Company (“Empire”) and the defendant, Continental Casualty Company (“CNA”), over the obligation of each insurance carrier, if any, to indemnify and defend John B. Coleman Trucking, LLC (“Coleman Trucking”) pursuant to commercial automobile insurance policies. Now pending before the court are cross motions for summary judgment. For the reasons that follow, I will grant CNA’s motion and deny Empire’s motion.
