This is a case about a crane — -and about whether the company that leased the crane can be held accountable for the crane’s failure to meet safety standards promulgated under the Occupational Safety and Health Act (“OSH Act”). In this case, Anthony Crane Rental (“ACR”), a company which leases and services cranes, appeals a decision of the Occupational Safety and Health Review Commission (“Commission”), penalizing it for violations of the safety standards for cranes used in construction.
